How do I apply for Legal Aid?

Silverstone Solicitors has a Legal Aid Agency Contract for aspects of criminal law. From October 2022, our solicitors can take you through your application for public funding (Legal Aid).

We give our clients an initial free consultation to assess your Legal Aid eligibility criteria, to review your circumstances and help you with your Legal Aid application.

You Will Be Eligible For Legal Aid Scheme:

  • If you are in receipt of certain benefits (Income Support or Job Seekers Allowance, Employment Support Allowance), or any other low income.
  • You will need to provide us with your National Insurance Number, proof of your receipt of benefits, photo I.D. and 3 months bank statements.

Legal Aid at the Police Station

From October 2022, we will offer free legal advice at the police station if you are eligible for Legal Aid, if you are arrested, or asked to attend an interview, regardless of your financial situation.

We suggest you don’t say anything to the police until you have discussed your matter with us. If you make a mistake during your police interview, it could lead to charges or even worse, a term in custody. Take into consideration every offence has a defence.

Legal Aid at Court

You have a right to a fair trial regardless of your financial circumstances. We can assess your circumstances and tell you whether you are eligible to Legal Aid for representation at court.

You may be entitled to get Legal Aid to pay your solicitors or barristers’ costs if you will pass the two tests:

For Magistrates’ Court:

Firstly, there is a means test. This test helps to show the court that you need help with financing because you have low income. The next test is known as a merit test, in which you must prove that it would be in the interest of justice if you were to have legal representation.

For Crown Court:

There is only a means test for the Crown Court to view you as eligible for funding. The reason as to why there is no merit test is because the courts position is that it will automatically be in the interests of justice if you obtained legal representation for your defence.

What If I Don’t Qualify For Legal Aid?

If your case is being heard in the Magistrates’ Court, but you do not qualify for Legal Aid, rest assured as you can still instruct us to represent you on a private paying basis.  We can offer competitive rates for your defence.
